On February 26, 2021, Magnolia Police stopped Nela Renee Byerly-Eaton on FM 1774. He originally stopped her for defective third brake light, however, she was also drifting toward the concrete barrier wall. She was unable to get out of the vehicle on her own and was staggering once she was out. Inside the vehicle, the officer found a 32-ounce tumbler that emitted the odor of alcohol. During field sobriety tests Byerly-Eaton almost fell. When he asked her to blow in the portable breath analyzer she refused and told the officer, “I would rather go to jail”. She did agree to a blood draw. She was then booked into the Montgomery County Jail and released on a $2000 bond In August the DPS Lab provided the alcohol results which were .274. The legal limit is .08, she was more than three times the legal limit.
