Just after midnight, a Precinct 4 Deputy stopped a vehicle on traffic at Kingsport and I-69. Inside the vehicle was Diego Herrera, 26, of Splendora. In addition was a 6-month old boy, After deploying his K-9 which detected drugs a search was done on the vehicle. Marijuana was found inside the baby’s formula container and it was determined he had been using drugs with the child in the vehicle. When the deputy checked for open warrants on Herrera he found that he was being sought by Child Protective Services in Dallas. The child had been removed from the home prior but was given back 2-months ago. That was when he vanished. CPS was contacted and responded to the scene taking custody of the child. Herrera was booked in the Montgomery County Jail on possession of marijuana. Additional charges are possible.
